These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and Digital Lab, 47 Rue Vivienne, 75002 Paris, France, SIREN 102 795 531 ("Digital Lab", "we"), governing your access to and use of digital-lab.app and our services (the "Service").
1. Account
You must be at least 18 years old and able to enter into a binding contract. You are responsible for the activity under your account and for keeping credentials secure.
2. Subscription, credits and billing
Access is sold as credit packs and/or subscription plans described on our pricing page. Fees are billed in advance and are non-refundable except as set out in our Refund Policy or required by law. Prices are in EUR and exclude applicable VAT.
3. Acceptable use
You agree to comply with our Acceptable Use Policy and applicable law. We may suspend or terminate the Service for material breach.
4. Intellectual property
Digital Lab owns all rights in the Service, including software, models, and content we provide. You retain rights in data you submit ("Customer Data") and grant us a limited license to host and process it to deliver the Service.
5. Third-party integrations
The Service connects to third parties (e.g. Shopify, AliExpress, CJ Dropshipping, Stripe). Their terms apply to your use of those services. We are not responsible for third-party availability or actions.
6. Warranties and disclaimers
We provide the Service with reasonable care and skill. To the maximum extent permitted by law, the Service is provided "as is" without other warranties, express or implied.
7. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees paid by you in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
8. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, suspected fraud, or to comply with law.
9. Governing law
These Terms are governed by French law. The courts of Paris, France have exclusive jurisdiction, subject to mandatory consumer-protection rules.
